This app is provided by Doka GmbH, Josef-Umdasch-Platz 1, 3300 Amstetten, Austria ("Doka"). It contains information about products, solutions and services of Doka or other companies of the Umdasch Group ("Products, Solutions and Services of Doka"). This app is intended as a game. Users of the App are referred to as "Players". The aim of this app is to give players an insight into Doka and its solutions. The information and processes shown are intended as a game and therefore abstract and simplify. The information shown in the app does not replace user information, which alone is decisive for instructions on the use of Doka products, solutions and services. Information from the app may not be used as a basis for decisions on the use of products, services or solutions from Doka, other companies in the Umdasch Group or other third parties. If you have any questions about the solutions shown, please contact your local branch. User information is available for download at www.doka.com/downloads.

2. conclusion of contract

By accepting, players agree to the unrestricted applicability of these Terms of Use. The start of use is deemed to be proof of acceptance of the Terms of Use. Doka would like to point out that the app and all contents of the app are protected by copyright or other intellectual property rights even before acceptance of these Terms of Use.

3. exclusion of warranty and liability

This app was created to the best of our knowledge and belief and carefully checked before being made available. This app is provided free of charge. No guarantee or warranty can therefore be given that it is completely free of errors. Doka does not warrant, among other things, the uninterrupted availability of the app, merchantability, fitness for a particular purpose, non-infringement of third party rights or the absence of defective or malicious software.

Doka Quest AR is provided free of charge until further notice and to the extent permitted by law to the exclusion of any warranty rights.

Doka shall only be liable for personal injury within the scope of the mandatory statutory provisions; Doka shall only be liable for other damage in cases of gross negligence and wilful intent.

Doka shall not be liable for consequential damage, financial loss or loss of data, irrespective of the legal grounds.

4. Changes to the terms of use and/or the app

Doka reserves the right to amend the App and/or the Terms of Use at any time (in particular with regard to future payment).

Changes to the Terms of Use will be communicated to players in writing either via the app or via the information processed during download or registration. If communication via the App is not possible or no registration is provided for, Doka may also discontinue the App (i) by means of a notice in an update voluntarily provided by Doka, (ii) as part of the publication of a successor App in the App Store or (iii) on a Doka website and prohibit the use of the App already installed on the Player's end devices. Significant changes to the contract (e.g. introduction of payment, etc.) require the consent of the players. If this is not granted (e.g. by not executing an update voluntarily provided by Doka), the permission to use the app shall end within 14 days of notification of the change.

Doka has the right to discontinue the provision of the app at any time without giving reasons.

Doka reserves the right to make changes to the app and to provide updates, for example. Doka will provide information about the availability of updates in a suitable manner, e.g. by making an update available in the App Store. Doka shall not be liable for any damage caused or increased by the non-implementation of updates. Doka is under no obligation to provide updates for the free app.

5. intellectual property and licence

The information contained in the Doka Apps constitutes the intellectual property of Doka GmbH and may not be modified, supplemented, sold, leased or otherwise commercially exploited in any way whatsoever without the prior written consent of Doka GmbH.

Doka grants players a licence to use the app to the extent that is absolutely necessary for the use of the app. This licence is non-transferable, cannot be sublicensed, can be revoked at any time and is restricted to the private sphere of the players. Commercial use is excluded.

Doka reserves the right to discontinue the operation of the Doka website or the Doka apps at any time. In the event of notification via the app or the app store, players must uninstall the app.

6. data charges

Data charges may apply when using this app. Roaming charges may also apply abroad. To avoid increased charges abroad, deactivate data roaming. This setting can be changed again at any time.

7. final provisions

Should one or more provisions of these terms of use be or become invalid in whole or in part, or should there be a loophole in the provisions, this shall not affect the validity of the remaining provisions. Wholly or partially ineffective provisions or loopholes are hereby replaced by an appropriate effective provision which, as far as legally possible, fulfils the intended legal and economic purpose or comes closest to it.

The place of fulfilment is Amstetten, Austria.

Austrian law shall apply exclusively, to the exclusion of the Austrian IPRG and the UN Convention on Contracts for the International Sale of Goods. The exclusive place of jurisdiction for all disputes shall be the registered office of Doka GmbH in 3300 Amstetten, Austria or, at Doka's discretion, any other legally permissible place of jurisdiction.
